WHY DOES FOSSIL RIDGE CHARGE ME FOR MY SEWER AND HOW IS IT CALCULATED?
Residents within the Fossil Ridge Metro Districts (FRMD) receive water service from Consolidated Mutual Water Company (CMWC). Waste water service is provided by FRMD through an inter-governmental agreement with Green Mountain Water and Sanitation District (GMW&SD).
The agreement between FRMD and GMW&SD requires GMW&SD to bill FRMD for wastewater services and FRMD subsequently bills the homeowners for such use. The Sewer Statements are due to Fossil Ridge Metropolitan District on the following dates:
GMW&SD invoices FRMD quarterly and breaks down the charges per address. GMW&SD charges are based on the amount of water used in the months of January and February in the prior year. Until such a time that a winter average is calculated on your home, GMW&SD uses an amount of 4,500 gallons. Therefore, if there was no water used in the months of January and February of the previous year, your sewer bill is based on the average of 4,500 gallons for the year current year and will not change until the following year.

HISTORY OF THE RELATIONSHIP BETWEEN FOSSIL RIDGE - GREEN MOUNTAIN WATER & SEWER - CONSOLIDATED MUTUAL WATER COMPANY
The purpose of the following commentary on the history between Fossil Ridge, Green Mountain Water & Sewer and Consolidated Mutual Water Company is to provide you with enough back ground information to understand why and how your utility bills are currently managed.
In 2005, when Carma Colorado (now Brookfield Residential) purchased the development now known as Solterra, the property was within the boundaries of the Mount Carbon Metropolitan District. At that time, Mt. Carbon was the intended service provider for water and waste water to the property, however, Mt. Carbon’s did not have the ability to provide sufficient services to Solterra. Consequently, Carma sought a different water and waste water provider for the best interest of the community and excluded the Solterra property from the boundaries of Mt. Carbon.
As you may or may not be aware, one of your line items on your property tax bill is associated with Mt. Carbon. Prior to Carma’s involvement in Solterra, Mt. Carbon had completed their bankruptcy proceedings, effective 2002. The court order concluding the bankruptcy required that property within the then known Springfield Green subdivision was required to pay an ad valorem property tax of 20 mills for the purposes of retiring outstanding debt. This tax will continue to be collected through approximately 2044 unless the debt is retired earlier.
After Carma’s evaluation of the water and sewer services necessary for Solterra, Carma approached Consolidated Mutual Water (“CMWC”). In 2007, Carma purchased the lease rights for enough water for the full build out of Solterra. At that time, Fossil Ridge Metropolitan Districts (“FRMD”) were formed for the purposes of facilitating the public infrastructure and financing the construction of the waterlines and storage tank in order to deliver the water that Carma had purchased to the community. The 6.5 mile long 16” waterline and 5 million gallon water tank comprise approximately $11.5 million worth of investment that FRMD funded. Additionally, all the trunk waterlines in Solterra are funded by the FRMD or Carma, but are owned and maintained by CMWC.
While receiving water from CMWC, CMWC worked with GMW&SD to procure a water exchange agreement that allowed the waste water from Solterra to flow through GMW&SD’s system. Because GMWSD was not authorized to extend their district boundaries because of restrictions with Denver Water, all of the waste waterlines in Solterra are owned by FRMD and are contracted to GMW&SD to maintain. As part of the maintenance of the system, GMW&SD coordinates with CMWC to determine water usage in order to calculate waste water flow. GMW&SD then invoices FRMD, which then invoices the homeowners.
